LAOAG CITY, Aug. 17, 2020–P/Chief Master Sergeant Harold Nicolas, PDEU-Ilocos Norte head, said they respect the court decision dismissing the illegal drug case filed against a practicing lawyer here.
CMSgt. Nicolas said they were dismayed but still they respect the decision of the Regional Trial Court, Branch 14, this city dismissing the case in favor of the accused lawyer.
He explained that they lost the case in court due to the lack of three witness-requirements needed in their complaint against the accused.
The three witness-requirements were present only during the inventory of the prohibited drugs seized from the accused, he added.
The court also gave weight to the defense of the accused questioning the chain of custody of evidence.
It may be recalled that the accused was arrested by Philippine Drug Enforcement Unit agents here for the illegal drug last July 29, 2019, in Laoag City. (tri-media report)
